WORKERS’ COMPENSATION PROCEDURES

(Work-Related Injury or Illness for Employees)

I.

Reporting

a.

Report to Principal:

All work-related injuries or illness must be reported immediately to the principal or immediate supervisor.

b.

First Report of Injury:

The principal/immediate supervisor shall send this report to the Iberville Parish School Board office immediately when an injury is reported to him/her.  The employee should check with the principal/immediate supervisor to be sure the injury has been reported to the central office on the proper form.

NOTE:

If notice is not given to the School Board office and/or insurer within thirty (30) days of injury, no payments (medical or otherwise) shall be made, in accordance with the workers’ compensation statutes.

c.

Medical Attention:

If the injury requires attention of a physician, the principal/immediate supervisor shall be notified by the employee immediately and a copy of the First Report of Injury shall be presented to the doctor during the initial medical examination.

d.

Medical Bills:

The employee should advise the doctor, hospital, etc., that services are to be billed to the workers’ compensation carrier as listed on the First Report of Injury and marked Workers’ Compensation.  If employee is required to or desires to pay for services or medication, employee should bring copies of bills marked Paid to the School Board office.  These bills will be sent to insurer for reimbursement to employee.

NOTE:

The School Board and/or insurer has the right according to law to choose another physician for a second opinion, and employee shall be required to submit to this medical examination.

II.

Use of Accumulated Sick Leave for Work-Related Injury in Lieu of Workers’ Compensation Payments.

Each employee has a right, under existing law, to either use accumulated sick leave time for absences due to job-related injuries or receive workers’ compensation payments, or a combination of both not to exceed the total amount of regular salary.

a.

Pay Option Form:

The employee must execute Pay Option Form.  This will be supplied by the central office.

b.

Workers’ Compensation Payments:

1.

If an employee does not have accumulated leave or chooses to retain accumulated  and receive only workers’ compensation payments, payments will begin on the eighth day after the first day of injury.   Compensation will be paid weekly at a rate of 66⅔% of the employee's weekly salary (based on 52 weeks) up to the state allowed maximum per week. Accumulated leave will not be deducted and regular salary will not be paid.  The employee will only receive payments as outlined above from insurer.

2.

It is important for employees who are receiving only compensation payments to make arrangements with the bookkeeping department relative to deductions being made from present salary for insurance, etc.  Employees who elect workers’ compensation payments only will be required to pay both the employee and employer portions of insurance premiums.  Retirement credit for time on compensation must be purchased by employee.  Employees who choose to pay retirement must bring payment to the School Board office no later than ten (10) days of the date of check from the workers’ compensation carrier.

c.

Use of Accumulated Leave or Coordination of Benefits:

1.

An employee may choose to coordinate pay between Workers’ Compensation and Accumulated Sick Leave.  After the first seven (7) days workers’ compensation will pay up to 66⅔% of an employee’s weekly salary based on 52 weeks up to the state allowed maximum per week.  The School Board will pay the remaining portion for as long as employee has unused sick leave.  The School Board will pay full salary for the first seven (7) days and deduct seven (7) days accumulated leave; thereafter, a proportionate share of unused sick leave corresponding to the amount of salary paid will be charged against accumulated leave.

When all accumulated leave is exhausted, the employee will only receive compensation payments at rate above outlined.  Payments to an employee for the proportionate share of his/her salary while on workers’ compensation will be made only on normal payroll dates.  Only mandated deductions (i.e. taxes, retirement, garnishments, etc.) will be deducted from the employee’s payroll check during workers’ compensation.

Retirement will be paid only on the proportionate payroll check issued by the School Board (not on checks issued by the school system’s workers’ compensation carrier).  Employees may elect to pay 100% of retirement while receiving workers’ compensation benefits.  Employees on workers’ compensation who choose to pay full retirement must bring payment to the School Board office no later than ten (10) days of the date of the check from the workers’ compensation carrier.

2.

No insurance deduction will be made while an employee is on workers’ compensation.  Employees will be notified by the central office as to the amount owed to continue insurance benefits while receiving workers’ compensation benefits, and all insurance premiums are due on the first of each month. Insurance coverage for employees on workers’ compensation who fail to pay their premiums timely will be cancelled for Failure to Pay Premiums.

3.

An employee may choose to use only accumulated leave in lieu of workers’ compensation benefits.  The employee will be paid full salary until leave is exhausted.  Thereafter, workers’ compensation will begin at a rate of 66⅔% of weekly salary up to the state allowed maximum per week.  Accumulated leave will be deducted for each day full salary is paid and all deductions, mandated and voluntary, will remain as they were prior to the accident until all accumulated sick leave has expired.

III.

Employee Return to Work:

Any employee who is absent from work due to a work-related injury or accident must provide the central office with a physician’s statement releasing them back to work prior to returning to their assigned campus.  If released to light duty, and deemed necessary, the central office will compile a transitional schedule of duties in order to accommodate the restrictions listed by the physician.  If limitations set forth by the physician are too restrictive, the Iberville Parish School Board reserves the right to not allow the employee to return to work until less restrictive capacities can be achieved.
